Is CBD + CBDa Federally Legal?

It wasn’t until 2015 that the FDA eased most regulatory requirements for researchers so they could start using CBD in trials. As we mentioned, this is why there is so little solid information about CBD. Then, as mentioned, the Farm Bill of 2018 made hemp legal in the country. This made it nearly impossible to fully ban CBD. But some states just aren’t feeling this compound.
Why Do Different States Have Different Laws Regarding CBD – Is CBD Legal In Florida?
As mentioned previously, there are different laws governing CBD across the country. While hemp was legalized on a Federal level, states still dictate how you can use the compound within their borders. In fact, in 2019, Florida passed a bill that made it legal to sell medical marijuana in certified treatment centers. (But only for qualified buyers).
But is CBD legal in Florida? As of now, CBD is legal to both consume and grow in the state. The only specification that Florida has is that it cannot contain more than 0.3% of THC by dry weight. If it contains more than 0.3% THC, it’s not legal in the state of Florida. Currently, there is no active license needed to consume this product. However, if you want to grow and sell it, you will need to get a state valid license.
Different states have different laws because each one has its own requirements, and each legislature governs in different ways. The majority of states that have some sort of restrictions on using CBD for recreational use do so because they’ve yet to get the kind of regulation they are looking for within the industry. Some states claim they cannot enforce the right kind of safety precautions because CBD is not FDA-approved.
And that’s true. Because these extracts are considered supplements. They aren’t approved, regulated or vetted by a governing body. Another reason has to do with the way CBD is derived. A lot of states are perfectly fine with CBD use, as long as it’s extracted from hemp and doesn’t contain too much THC.
Is CBD Safe?
This is something that a lot of people have questions about when they see how restricted CBD is and when they learn that some states do not allow its use freely. If you are wondering whether or not CBD is safe, it’s best to talk to your doctor. While there is still a lot more research to be done on whether or not it’s completely safe, the most common side effects that have been observed are relatively mild. Some of the more common side effects of CBD are dry mouth and diarrhea. Also, some may notice they have a decreased appetite. Florida Rules For Using and Growing
Using: Florida is a state that doesn’t require any sort of license to use CBD. You don’t need a license to use and consume CBD in Florida as long as you are over the age of 18.
Growing: When it comes to growing and cultivating, you cannot do so without a license. Like a lot of the other states in the USA, you will need to apply for a license to grow and/or sell these types of products. You also need to get a food establishment permit if you are looking to sell consumable CBD products. One of the specifications Florida has for growing and selling CBD is its THC content. The CBD cannot have more than 0.3% THC content in it. Otherwise, it cannot legally be sold or consumed in Florida unless you have a medical marijuana license. Therefore, you would need to ensure the CBD is being derived from hemp plants.

The states are still in control over whether or not things like CBD and THC can be consumed legally. Some states have legalized marijuana and more are expected to continue to do so shortly. CBD is usually grouped in with marijuana because a lot of people confuse it with having the same effects as THC.
